Not-for-profit organizations that provide human services, social services and healthcare services face a unique array of legal and business issues. Our firm works closely with a variety of agencies that provide services for individuals with developmental disabilities, including intellectual disabilities, cerebral palsy, Down syndrome, autism spectrum disorders and other neurological impairments. We also work with a variety of behavioral health providers including psychiatrists, psychologists, and outpatient mental health and substance use disorder clinics and programs. We take pride in our work within this field, which requires a careful understanding of our clients’ programmatic, fiscal, and operational needs. The type of matters we handle in this industry include (i) corporate work (e.g., formation, application for federal tax exemption, mergers and acquisitions, dissolution, and governmental approval of fundamental corporate actions); (ii) real estate and financing, including municipal tax exempt bonds, for group homes, schools, and day habilitation facilities; (iii) anti-discrimination litigation in State and Federal Courts to enforce the rights of persons with disabilities to live and access services in the community; and (iv) representing organizations and families in guardianship proceedings, supplemental needs trusts and community trusts, as well as preschool and school-age students with disabilities pursuant to the Individuals with Disabilities Education Act.
